Article 2 of the Civil Code states that minors under 18 have no legal capacity and therefore cannot sign contracts; for this reason, they cannot stay in the hotel alone.
Additionally, Article 318 of the Civil Code prohibits minors from leaving home without parental authorisation.
A minor can only stay in the hotel if accompanied by:
- at least one parent, presenting an identification document
- a third adult who is not a parent, provided they have written and signed permission from the parents, accompanied by a copy of their ID, and the minor’s own ID
Article 109 of the TULPS confirms that hoteliers must request this written consent for unaccompanied minors.
In summary:
- Minors can stay with at least one parent, showing a valid ID
- Minors can stay with a different adult only with a signed permission form and attached documents. Download the minor permission form here
- Minors cannot stay alone, even with ID
